New York Residents: If you have received notice of intent to foreclose.  If your lender will no longer accept payments from you or if you are over 90 days past due on your mortgage payments your COVID-19 relief is ending.  Courts in New York state will allow new lawsuits to be electronically filed statewide.  The state court system will allow new e-filed cases.  In 30 counties, judges and staff in upstate New York courthouses have physically returned, while harder hit downstate courts will continue to conduct business remotely.

Remote court activities does not mean foreclosures will continue to be on hold.  A significant number of foreclosure cases are now freed to commence.  If your mortgage lender did not arrange a forbearance for you and you are in default, your biggest asset may be at risk.
